General Terms and Conditions (GTC) for Coaching and Training
1. Contracting parties and scope
These terms and conditions govern the legal relationship between the coach (hereinafter referred to as "Coach") and the company/client (hereinafter referred to as "Company/Client") that uses coaching and/or training services. They apply to contracts with both companies and self-paying individuals.
2. Conclusion of the contract
A coaching or training contract is formed when the client and coach agree to work together towards a defined goal. This agreement can be made directly with the coach or through the company. For self-paying clients, the agreement is made directly between the coach and the client.
3. Multi-session agreement and payment terms
When booking multiple sessions, a 50% deposit of the total price is due before the first session. The remaining balance is due before the final session. Individual sessions can be paid directly in cash or by card by prior arrangement.
4. Services
The coach commits to providing the agreed-upon coaching or training services professionally and diligently. A specific outcome is not guaranteed, as coaching is an individual and interactive process. The client only utilizes services that are not a substitute for therapy or psychological treatment. The coach works with healthy individuals in a professional context.
5. Scheduling and Cancellation of Appointments
Appointments are scheduled by arrangement. Cancellations or rescheduling are free of charge up to 24 hours before the appointment. For cancellations made later or in case of no-show, the coach may charge a cancellation fee of 100%.
6. Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days.
7. Liability
The coach's liability is limited to intent and gross negligence. The client is responsible for the practical implementation of training or coaching content. Furthermore, coaching does not replace psychological counseling or therapy.
8. Data protection
Personal data is protected in accordance with the applicable provisions of the General Data Protection Regulation (GDPR) and Austrian law and is only used with the consent of the data subjects.
9. Severability Clause
Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
